TERMS AND CONDITIONS

AGREEMENT TO TERMS
These Terms and Conditions (“Terms”) govern your access to and use of the website, services, products, engineered drawings, fabrication services, and related offerings provided by Florida Steel Frame & Truss Manufacturing (“FSFTM,” “Company,” “we,” “us,” or “our”).
By accessing our website or purchasing our products or services, you agree to be bound by these Terms. If you do not agree, you must discontinue use immediately.
COMPANY INFORMATION

SCOPE OF SERVICES
FSFTM provides:

  • Engineered cold-formed steel framing systems
  • Steel truss manufacturing
  • Structural shop drawings and design coordination
  • Prefabricated wall panels and components
  • Project-based fabrication packages
  • Material supply and delivery coordination

All services are subject to project-specific agreements, estimates, and approved drawings.

Prohibited Use

QUOTATIONS & ORDERS
Quotes
All quotes:

  • Are valid for the time period stated (if not stated, 30 days)
  • Are subject to material price fluctuations
  • May require revision based on final engineered drawings

Order Acceptance
An order is not confirmed until:

  • Written acceptance is issued by FSFTM, and
  • Required deposit payment is received.

FSFTM reserves the right to refuse or cancel any order.
PAYMENT TERMS

  • Payments are due as stated in the invoice or contract.
  • Deposits may be required before engineering or fabrication begins.
  • Late payments may incur interest at the maximum rate permitted by law.
  • Client is responsible for all collection costs, including legal fees.

All payments must be made in U.S. Dollars.
CUSTOM ENGINEERED PRODUCTS – NO CANCELLATION
FSFTM products are custom engineered and fabricated per project specifications.
Once:

  • Engineering has begun, or
  • Materials have been ordered, or
  • Fabrication has started

Orders cannot be canceled and are non-refundable.
DELIVERY & RISK OF LOSS
Shipping
Delivery dates are estimates only. FSFTM is not liable for delays caused by:

  • Supply chain disruptions
  • Carrier delays
  • Weather events
  • Force majeure events

Risk Transfer
Risk of loss transfers to the customer upon:

  • Delivery to carrier, or
  • Pickup from FSFTM facility

Customer is responsible for inspection upon receipt.
SITE RESPONSIBILITIES
Customer is responsible for:

  • Verifying dimensions and field conditions
  • Providing accurate project specifications
  • Obtaining necessary permits and approvals
  • Ensuring proper installation by qualified professionals

FSFTM is not responsible for improper installation or jobsite modifications without written approval.
ENGINEERING & CODE COMPLIANCE
Where applicable, FSFTM provides engineered drawings sealed by licensed professionals.
However:

  • Final building code compliance approval rests with local authorities.
  • Customer must confirm jurisdictional requirements prior to fabrication.
  • Revisions requested after approval may incur additional fees.

WARRANTIES
Limited Warranty
FSFTM warrants that fabricated steel components will be free from material defects under normal use for a period defined in the project agreement.
Exclusions
Warranty does not cover:

  • Improper installation
  • Jobsite damage
  • Corrosion due to environmental exposure
  • Modifications without written approval
  • Acts of God, fire, flood, hurricane, or misuse

THIS WARRANTY IS IN LIEU OF ALL OTHER WARRANTIES, EXPRESS OR IMPLIED.
LIMITATION OF LIABILITY
To the fullest extent permitted by law:
FSFTM shall not be liable for:

  • Indirect damages
  • Consequential damages
  • Loss of profits
  • Project delays
  • Business interruption

Total liability shall not exceed the total amount paid for the specific product or service giving rise to the claim.
INTELLECTUAL PROPERTY
All content including:

  • Shop drawings
  • Engineering designs
  • Structural layouts
  • Website content
  • Logos and branding

Remain the exclusive property of FSFTM.
Drawings may not be reused, modified, or transferred to other projects without written consent.
FORCE MAJEURE
FSFTM shall not be liable for delays or failure to perform due to events beyond reasonable control, including:

  • Natural disasters
  • Hurricanes
  • Labor shortages
  • Government restrictions
  • Material shortages
  • Transportation disruptions

SMS & COMMUNICATION CONSENT
If you provide your phone number, you consent to receive:

  • Project updates
  • Delivery notifications
  • Order confirmations

You may opt out at any time by replying “STOP.”
Message and data rates may apply.
INDEMNIFICATION
Customer agrees to indemnify and hold FSFTM harmless from claims arising out of:

  • Improper installation
  • Structural misuse
  • Project modifications
  • Third-party contractor errors

GOVERNING LAW
These Terms shall be governed by the laws of the State of Florida, United States.
Any disputes shall be resolved exclusively in the courts located in Florida.
DISPUTE RESOLUTION
Before initiating legal action, both parties agree to attempt resolution through good-faith negotiation.
If unresolved, disputes may proceed to mediation or litigation as permitted by Florida law.
MODIFICATIONS TO TERMS
FSFTM reserves the right to update these Terms at any time. Continued use of services constitutes acceptance of revised Terms.
